What is GATCA?
GATCA is the common term for a range of global regulations designed to detect, deter and precent tax evasion by forcing financial institutions to report accounts held by non residents to their home country’s tax authority. GATCA stands for Global Account Tax Compliance Acts. These include the US Foreign Account Tax Compliance Act (FATCA) regulations, the UK equivalent of FATCA, and more recently the OECD Automatic Exchange of Information (AEoI) and Common Reporting Standard (CRS).
Why do UK accountants need to know about GATCA?
UK accounts may have clients who are liable to tax in more than one country or who are not UK residents ‘for tax purposes’. The effect of GATCA is that the financial accounts operated by these clients will be reported to the tax authorities in these other jurisdictions. These clients will be aware of these regulations from media coverage. They may also be subject to requests for information from financial institutions at which they operate accounts. Clients however may not be aware of how and why they may be reported to a foreign government. They will expect their accountant to be be aware of the regulations and be able to provide informed comment on them as part of their role.
Who is affected by GATCA?
The regulations affect both individuals and ‘entities’ such as corporations, trusts, partnerships and other collective investment vehicles.
